Misdemeanor Battery Defense in Daytona Beach (Case No. 2017 304728) – Mr. Hobby was charged with Battery which also served as the basis for a felony violation of probation. Without waiving speedy trial and in under 60 days, defense counsel prepared for trial. Thanks to the counsel’s aggressive motion practice, the Judge excluded audio tapes of jail calls (all jail calls are recorded) which the State failed to produce until the Friday before trial. Because the Government had lost the parking lot video of the incident, defense counsel also successfully argued to exclude any reference to the video tape and prohibit witnesses from commenting on what was on the video that had been lost. Defense counsel argued our client acted in reasonable self-defense after having been harassed, intimidated and threatened at the bus transfer station. Defense counsel successfully cross-examined the State's alleged victim, who was in jail awaiting trial on felony charges. Although the State presented eye witness testimony from a parking lot attendant and a police sergeant, the Jury rejected the Government's witnesses and their argument, finding an emotional Mr. Hobby not guilty in less than 30 minutes.

Sex Crimes Defense in DeLand (Case No. 2015 101845) - Mr. Minton was accused of sexual battery on an incapacitated person and kidnapping, punishable by life in prison. The State tried to admit similar fact evidence from a prior offense over 20 years ago, but we defeated that motion. After three days of trial, the State rested their case. The Judge found, as a matter of law, the State had not proved the charge of kidnapping and directed the charge be dismissed, granting a judgment of acquittal. The State then agreed offer Mr. Minton a plea of one year probation to the misdemeanor charge of simple battery. Because of Mr. Minton's prior history and because he was already a sex offender, futher civil commitment was a major concern and this plea offer avoided any chance of Mr. Minton being held under the Jimmy Ryce Act. Mr. Minton accepted the State's offer to avoid the risk of thirty years in prison. After the trial, several jurors told the defense team they would have voted not guilty.

DUI Defense in Daytona Beach (Case No. 2015 312264) - Client was stopped for running a red light directly in front of a police car. Once stopped officers noticed indicators of impairment and the client performed poorly on field sobriety exercises resulting in her arrest for DUI. The client agreed to take a breath test and the results were nearly three times the legal limit. Counsel filed a Motion to Suppress alleging that the breath test was a product of coercion by law enforcement. The court granted the defendant’s motion and suppressed the breath test results. The State was still unwilling to offer a reduction in charge and the case proceeded to trial. At trial the defendant was found not guilty in less than 30 minutes.
